In Scotland, reform has taken longer; the Scottish Parliament is now considering the Defamation and Malicious Publications (Scotland) Bill. There are currently significant distinctions between the two jurisdictions, such as:
- Only in cases where the defamatory statement resulted in “serious harm” can an action be filed in England. In Scotland, there is no such threshold.
- Website operators in England are entitled to a particular defence. In Scotland, no such clause is applicable.
- Proceedings must be started in England within a year of the publication date. In Scotland, the deadline is three years.
